Payment and Refund Issue

All payments for services at RealEstateIndia.Com have to be made in favour of "WeblinkIndia.NET Pvt. Ltd." only. We have not authorized any individual or organization to collect payments in any other name (i.e. any other individual or organization name) for any services rendered by RealEstateIndia.Com. You are informed that under no circumstances will RealEstateIndia.Com be liable for any damage caused in your business transaction to such fraudulent individuals or organizations.

Limitation of Liability

The User is warned against disclosure of any personal / confidential / sensitive information to any previous or current employee of the company. The User would do so solely at his / her own risk and Site / Company shall not be liable for the outcome of any such transaction of information including and not limited to damages for loss of profits or savings, business interruption, loss of information or repute.

Defined Terms:

Authorized customer :- The term ’authorized customer’ would include any person, whether an individual or a legal entity who has subscribed to the services of http://www.realestateindia.com/, and to whom the access is restricted by the use of a sign in customer name and a password. To protect the secrecy of customer Identification and/or password the customer shall take all such measures as may be necessary (including but without limiting to changing his password from time to time and shall not reveal the same to any other person(s).

Since a customer identification is necessary to access the Service; the customer shall use only his own customer Identification.

In the event of theft or loss of customer name or password, the customer shall notify the Company immediately by telephone or personally concurrently provide the Company with a written notice to that effect. The customer shall remain liable for use of the Services by any third party until such theft or loss is notified to the Company.

The password and customer name being made available to the customer shall be used only by the organization named by the customer and the employee of the organization. The customer shall take all necessary precautions to prevent un-authorized access or leakage of customer name or password being provided by the Company to him.

Cancellations and alterations shall be effected only on the receipt of application regarding the same in writing.

Website designing services:-

1. Website designing service is one of the deliverables with some of Paid Services and the Site reserves the sole rights on its technical maintenance. Each User hereby agrees to indemnify and save the Site/Company, its affiliates, directors, officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis) which may arise due to interruptions because of Third Party Services, technical errors while uploading or after hosting of website.

2. As Website designing service is a free service with some of the Paid Services, hence the Site retains the sole rights of all the technical details including FTP details. No claim(s) shall be entertained regarding the same. Since the data of the template based website is driven through the centralized database of the Site, hence it is non-transferable on any other server and any such attempt would render the website non-functional.

4. The Users hereby agree to extend full cooperation in assimilation of the information required for site development and approve of correspondence by phone/mail. Reminder mails would be sent if the Users do not respond to calls/mailsand/or do not provide the details/material requested and/or do not provide necessary approvals/feedbacks on progress of website/incomplete material/ incomplete images/layout/ hosting of website etc.The website designing service would be terminated / lead as per the company policy if no revert is received from the User after the 2nd reminder mail. Re activation of website designing services / request for modification would be only on paid basis.

5. On completion of website development, the temporary link would be sent to the Users and modifications would be entertained only if the same are sent within the next 5 days. On lapse of the 5 days, if no feedback is received, it would be deemed as consent for hosting the site on the domain.

6. All changes, after website hosting would be undertaken on paid basis.

7. Any exception / flexibility in the above circumstances would be at the sole discretion of the Site and would require a written request from the User.

There are no express representations and warranties, whether express or implied, made by the Company regarding the accuracy and/or quality of any information transmitted and/or obtained through the use http://www.realestateindia.com

The Company shall not be liable for any disclosure of information concerning the customer’s account or particular’s nor for any error and/or omissions or inaccuracy with regard to information so disclosed. In addition The Company shall further not be liable for any loss or damages sustained by reason of such disclosure, weather intentionally or inadvertently.

In case the there is any loss of information, caused due to any reason, weather as a result of any disruption of service, suspension or termination of the Service, the Company shall not be liable in any way for the same. Further the Company is not responsible for the accuracy, quality and/or contents of any information available, received and/or transmitted through this Service.

The customer understands and agrees that any information or material or goods or services obtained through this website is done at customer’s own discretion and risk and that customer shall be solely responsible for any damages or cost or any other consequences resulting from any transaction.

The customer shall ensure that while using the Service, all prevailing and applicable laws, rules and regulations, directly or indirectly for the use of systems, service or equipment shall at all times, be strictly complied with by the customer and the Company shall not be liable in any manner whatsoever for default of any nature regarding the same, by the customer.

If there is any dispute between the customers/participants on this site, it is agreed upon by the customers/participants that http://www.realestateindia.com/ has no obligation what so ever to be involved in any such disputes. In the event that the customer has a dispute with one or more customers or participant’s, the customer hereby undertake s not to make any claims or demands or damages (actual or consequential) of every kind or nature or known or unknown or suspected or unsuspected or disclosed or undisclosed, arising out of or in any way related to such disputes or our service against the http://www.realestateindia.com/ or their officers or employees or agents or successors.

Governing Law and Jurisdiction:-
This Agreement and any dispute or matter arising from incidental use Realestateindia.com is governed by the laws of India and the Member and the Company hereby submit to the exclusive jurisdiction of the courts at Delhi, India. This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the Realestateindia.com, contains the entire agreement between you and Realestateindia.com regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
